Welcome to www.ossauctions.com (“Site”), owned and operated by The Overstock Shoppe LLP (“we,” “us,” “our”). By accessing, browsing, creating an account, placing a bid, or making a purchase on this Site, you agree to these Terms & Conditions (“Terms”).

If you do not agree to these Terms, please do not use the Site.

1) Eligibility

You must be 18 years of age or older to create an account or make a purchase on this Site.

If you are under 18, you may only use the Site and make purchases with the permission and supervision of a parent or legal guardian, and that parent/guardian agrees to be responsible for your activity.

2) Accounts Required / Account Responsibility

An account is required to bid or purchase items on OSSAuctions.com. Guest checkout is not available.

You agree to:

  • Provide accurate and current account information

  • Maintain the security of your login credentials

  • Accept responsibility for all activity under your account

You are responsible for your username and password. If you believe your account has been compromised, you must contact us immediately at [email protected].

The Overstock Shoppe LLP reserves the right to suspend or terminate accounts for fraud, abuse, policy violations, or suspicious activity.

3) Local Pickup Only

All purchases made on OSSAuctions.com are local pickup only. We do not ship.

4) Pickup Deadline (“Same Week” Pickup Policy)

All purchases must be picked up by 4:00 PM Saturday of the same week they were purchased.

For the purpose of our pickup policy, “same week” is defined as:

✅ Purchases made between 4:01 PM Saturday and 3:59 PM the following Saturday

This means every weekly cycle ends at 4:00 PM Saturday.

5) Automatic Hold Fee (If Not Picked Up On Time)

If your items are not picked up by 4:00 PM Saturday of the same week, you authorize The Overstock Shoppe LLP to apply an automatic hold extension and the applicable hold fee.

Hold Fee Amount

  • $3.00 for the first item

  • $1.00 for each additional item

This hold extension allows pickup until the following Saturday at 4:00 PM.

6) Failure to Pick Up After Hold Extension

If the items are not picked up by the end of the extended hold period (the following Saturday at 4:00 PM), the item(s) will be considered abandoned and may be resold.

In that case, the customer will receive an in-store credit equal to 85% of the lesser of:

  • The price the item resold for, OR

  • The original purchase price

Store credit is non-refundable and may be subject to verification.

7) Pickup Requirements (Invoice or ID)

To pick up items, you must present either:

  • Your invoice (paper or electronic), or

  • A valid current government-issued photo ID

The Overstock Shoppe LLP reserves the right to refuse release of an order if we cannot reasonably verify ownership of the purchase.

8) Payments / Payment Methods

Accepted payment methods include:

In-Person: Cash, credit, or debit
Online: Credit/debit card or PayPal

9) Automatic Payment Collection (Card on File Authorization)

If your weekly order(s) are not paid by 4:00 PM Saturday, you authorize The Overstock Shoppe LLP to automatically charge the payment method on file for:

  • The balance due for your purchases, plus

  • Any applicable hold fees

10) Sales Tax

The Overstock Shoppe LLP charges the current applicable Trumbull County / Ohio sales tax rate of 6.75%, unless valid tax-exempt documentation is submitted and approved prior to purchase/payment where applicable.

11) No Lot Fee / No Buyer’s Premium / No Insurance Fees

The Overstock Shoppe LLP believes in fair pricing and transparent checkout.

✅ We do not charge lot fees
✅ We do not charge a buyer’s premium
✅ We do not charge insurance fees

12) Binding Bids & Purchases

All bids and purchases are binding.

By placing a bid or completing a purchase, you agree that you are entering a binding agreement to pay for the item(s).

13) Payment Deadline

The winning bidder or purchaser must pay by the first Saturday following the auction or sale, either online or in person.

To avoid a hold fee, the customer must also pick up within the defined “same week” window.

14) Declined Payments

If a payment is declined, the customer will have 6 calendar days to bring the account current.

If the account is not brought current within 5 calendar days, a $25 account reinstatement fee will apply.

The Overstock Shoppe LLP reserves the right to suspend purchasing privileges until the balance is paid in full.

15) Chargebacks / Disputes

If you have any issue with your purchase, you agree to contact The Overstock Shoppe LLP first before filing a chargeback with your bank or card provider.

If a chargeback is filed:

  • The customer’s account will be suspended

  • The customer must pay a $50 reinstatement fee

  • The customer remains responsible for the item purchase price and any associated costs

  • The customer agrees to pay any court costs related to collection or dispute

16) Auction Extensions (“Anti-Sniping”)

Any bid placed in the final 2 minutes of an auction will extend the auction by an additional 2 minutes.

This may repeat as long as bids continue to be placed within the final 2 minutes.

17) Proxy Bidding

Customers may place a proxy bid by entering their maximum bid amount. The Site will automatically bid on the customer’s behalf, up to the maximum amount.

18) Mistake Bids / Mistake Purchases

If a bid or purchase is made by mistake, you must notify The Overstock Shoppe LLP immediately.

We will review requests; however, we cannot guarantee that a bid or purchase can be canceled before an auction closes or a transaction is finalized.

19) Buyer’s Remorse Cancellation (Restocking Fee Policy)

If an item has been purchased via auction or “Buy It Now” and the customer changes their mind (“buyer’s remorse”), the customer may request a cancellation under the following conditions:

  • A 15% restocking fee applies

  • The customer may use this option one time per six (6) months

This is subject to approval and may not apply in all cases.

20) Listing Errors / Right to Cancel or Modify Sales

The Overstock Shoppe LLP makes every effort to list items accurately. However, mistakes can happen.

If there is an error in a listing (including but not limited to pricing, description, quantity, photos, or condition), The Overstock Shoppe LLP reserves the right to:

  • End the listing early

  • Cancel a sale

  • Refuse a transaction

  • Issue a refund or store credit where applicable

21) Item Conditions (Liquidation / Open-Box Nature of Inventory)

Items sold may be:

  • Overstock

  • Customer returns

  • Shelf pulls

  • Open-box items

Because of this:

  • Packaging may show wear

  • Items may have return labels

  • Items may not include original packaging (this will be stated in the listing when known)

The Overstock Shoppe LLP does its best to identify issues, missing parts, and condition notes, but, we are human, and things may be missed.

22) Our Guarantee

Unless stated otherwise, The Overstock Shoppe LLP guarantees eligible items at no additional charge.

Standard Guarantee

✅ 30 days from the date of purchase

Seasonal Guarantee Extensions

  • Holiday items purchased after the holiday: guaranteed until 30 days before the holiday the following year

  • Summer items purchased after Labor Day: guaranteed until Memorial Day of the following year

  • Winter items purchased after April 1st: guaranteed until October 1st

No Guarantee Applies To

❌ Items sold as Parts/Repair
❌ Pallet lots

23) Promotions / Coupons

From time to time, The Overstock Shoppe LLP may offer promotions, discounts, or coupon codes.

All promotions:

  • Are valid only during the stated time period

  • Cannot be extended beyond the stated dates

  • May be changed or discontinued at any time unless prohibited by law

24) Limitation of Liability

To the fullest extent permitted by law, the customer agrees that The Overstock Shoppe LLP is not liable for any damages, losses, injuries, or claims arising from the use, misuse, handling, or operation of any purchased item—whether direct, indirect, incidental, or consequential.

Customers assume responsibility for the safe use and proper handling of all purchases.

25) Acceptable Use / Prohibited Conduct

You agree not to:

  • Hack, scrape, manipulate, or damage the Site

  • Abuse the checkout or bidding system

  • Use bots or automation to interfere with auctions

  • Harass, threaten, or abuse our staff or other customers (online or in-store)

  • Attempt fraud, chargeback abuse, or account misuse

The Overstock Shoppe LLP reserves the right to refuse service and suspend or terminate accounts for violations of these Terms.

26) Intellectual Property

All logos, photos, text, and content on this Site are the property of The Overstock Shoppe LLP and may not be copied, reproduced, distributed, or used without express written consent of The Overstock Shoppe LLP.

27) Privacy Policy

Our Privacy Policy explains how we collect and use personal information. By using this Site, you also agree to our Privacy Policy:

28) Changes to These Terms

The Overstock Shoppe LLP may update these Terms at any time. Changes will be posted on this page.

By continuing to use the Site after changes are posted, you agree to the updated Terms.

29) Governing Law / Venue

These Terms are governed by the laws of the State of Ohio.

Any disputes shall be handled through the Trumbull County Clerk of Courts, and the customer agrees to be responsible for all applicable costs and expenses related to dispute resolution, including filing costs and court costs where permitted.
